1. Agreement to these Terms

These Terms and Conditions (“Terms”) govern your access to and use of Wibzaloo.com (the “Site”) and your purchase of products from Wibzaloo. In these Terms, “Wibzaloo,” “we,” “us,” and “our” refer to Wibzaloo, owned and operated by Wallace Trowell.

By using the Site or placing an order, you agree to these Terms and to the policies displayed or linked during checkout. If you do not agree, do not use the Site or place an order.

2. Eligibility

You must be legally able to enter into a binding contract in your jurisdiction to place an order. If you are under the age of legal majority, you may use the Site or make a purchase only with the involvement and permission of a parent or legal guardian.

3. Products and print-on-demand production

Many Wibzaloo products are produced on demand by third-party fulfillment providers after an order is placed. Product images are provided for illustration. Actual colors may vary slightly because of screen settings, materials, garment-dye variations, and the printing process. Product measurements may also vary within reasonable manufacturing tolerances.

We try to keep product descriptions, images, prices, and availability accurate, but we do not promise that all Site content will always be complete, current, or error-free. If a material error affects your order, we may contact you for instructions, correct the error, or cancel and refund the affected item.

4. Orders, payment, and taxes

When you place an order, you offer to purchase the selected products under these Terms. An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may decline or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or inventory errors, product unavailability, legal restrictions, or an inability to fulfill the order.

Prices are shown in the currency displayed at checkout. Applicable shipping charges and taxes will be shown before you submit the order when supported by the Site. You authorize us and our payment providers to charge the total shown at checkout to your selected payment method.

If we cancel an order after payment, we will refund the canceled amount to the original payment method.

5. Order changes and cancellations

Because products may enter production quickly, requests to change or cancel an order are not guaranteed. Send requests immediately to orders@wibzaloo.com with your order number. Once production has begun, an order normally cannot be changed or canceled except where required by law.

6. Shipping and delivery

Delivery dates are estimates unless Wibzaloo expressly states otherwise. Production time and carrier transit time are separate. Delays may occur because of carrier conditions, weather, peak demand, address problems, customs, or events outside our reasonable control.

You are responsible for entering a complete and accurate shipping address. If you notice an error, contact us immediately. We cannot guarantee that an address can be changed after production or shipment begins.

We will comply with applicable rules concerning promised shipment times, delay notices, cancellation rights, and refunds for unshipped merchandise. Risk of loss and legal title transfer as required by applicable law.

7. Refunds, replacements, and returns

All refunds, replacements, and return requests are governed by the Refund Policy posted on the Site and incorporated into these Terms. Because items are made to order, customer-remorse returns are generally not accepted. This does not limit any right or remedy that cannot legally be waived.

8. Promotions and discount codes

Promotions and discount codes are subject to any additional terms stated with the offer. Unless we state otherwise, promotions cannot be combined, have no cash value, and may be changed or withdrawn before an order is placed. A promotion will not be retroactively applied to a completed order unless required by law.

9. Intellectual property

The Site and its content, including Wibzaloo names, logos, graphics, artwork, photographs, product designs, text, and page layout, are owned by or licensed to Wibzaloo and are protected by applicable intellectual-property laws. You may use the Site only for personal, noncommercial shopping purposes.

You may not copy, reproduce, modify, distribute, sell, license, scrape, or commercially exploit Site content without prior written permission from Wibzaloo or the applicable rights holder.

10. Acceptable use

You may not use the Site to:

Break any applicable law or infringe another person’s rights
Introduce malware, harmful code, or disruptive technology
Attempt unauthorized access to the Site, accounts, or connected systems
Interfere with Site security, operation, or another user’s access
Use automated systems to scrape, harvest, or overload the Site without written permission
Submit false, misleading, fraudulent, or abusive orders or communications

11. Third-party services and links

The Site may use or link to third-party services, including payment processors, fulfillment providers, carriers, analytics services, and social platforms. Those services may have their own terms and policies. Wibzaloo is not responsible for third-party websites or services that it does not control, but this section does not reduce any responsibility Wibzaloo has for your order under applicable law.

12. Site availability

We may update, suspend, restrict, or discontinue any part of the Site when reasonably necessary. We do not guarantee that the Site will always be available, secure, uninterrupted, or error-free.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available.” Wibzaloo disclaims warranties that may legally be disclaimed, whether express or implied. This disclaimer does not apply to express product promises we make, remedies stated in the Refund Policy, or warranties and consumer protections that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Wibzaloo will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the Site or a product purchase when such losses were not reasonably foreseeable.

Where liability may legally be limited, Wibzaloo’s total liability for a claim involving a purchased product will not exceed the amount paid for the product giving rise to the claim. These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any liability or consumer remedy that cannot legally be limited or excluded.

15. Indemnification for misuse

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful misuse of the Site, your infringement of another person’s rights, or your material violation of these Terms. This section does not make a consumer responsible for Wibzaloo’s own acts or omissions.

16. Suspension or termination

We may suspend or end access to the Site when we reasonably believe a user has violated these Terms, engaged in fraud or abuse, threatened Site security, or created legal risk. Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, disclaimers, limitations of liability, and disputes.

17. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted on the Site with a new effective date. Changes apply prospectively and will not retroactively alter an order already accepted unless required by law or agreed to by the customer.

18. Governing law and disputes

These Terms and transactions through the Site are governed by applicable United States federal and state law. Any dispute will be brought in a court that has lawful jurisdiction unless the parties agree to another lawful resolution process.

Before filing a claim, you and Wibzaloo are encouraged to try to resolve the issue in good faith by contacting orders@wibzaloo.com. Nothing in these Terms requires you to waive a non-waivable consumer right or prevents you from contacting a regulator, consumer-protection agency, or payment provider.

19. Severability and waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.

20. Entire agreement

These Terms, together with the Refund Policy and any terms shown at checkout, form the entire agreement between you and Wibzaloo concerning your use of the Site and your purchase. If checkout terms conflict with these Terms, the more specific terms presented for the transaction will control to the extent permitted by law.
